Shirts Up Serigraphics & Solutions Terms and Conditions:

NOTICE. PLEASE READ THESE TERMS & CONDITIONS CAREFULLY. BY ACKNOWLEDGING THIS ORDER, YOU AGREE TO BE BOUND BY THE TERMS & CONDITIONS STATED BELOW.

TERMS AND LATE PAYMENT: Unless otherwise agreed upon, full payment must be made at time of placing order. If invoice is not paid in full within 30 days of completion a 10% fee will be applied to the invoice.
All projects require 100% payment in FULL. Net terms available by request, with approved credit application.

SHIRTS UP over/under run policy: SHIRTS UP reserves the right to 2-4% over/under run on any embellished and or printed items/services, and 3-6% on embroidered items. That includes misprints, bleeds, or damages. We recommend ordering a few additional items if an exact number is to be needed.
SHIRTS UP CANNOT BE HELD RESPONSIBLE FOR THE REPLACEMENT OF ANY SUPPLIED ITEMS THAT MAY BE DAMAGED OR MISPRINTED IN PRODUCTION. Always provide a spare or extra!

LIMITATION OF LIABILITY:
In no event shall SHIRTS UP or its licensors, suppliers, or vendors, their officers, directors, employees, or agents, be liable for any special, incidental, indirect, or consequential damages of any kind, or for any damages whatsoever resulting from loss of use, data or profits, whether or not SHIRTS UP has been advised of possibility of the damage, arising out of or in connection with the use or performance of the site or of failure to provide services that you order from SHIRTS UP or its affiliates, including without limitation, damages arising from mistake, omission, virus, delay, or interruption of service. In no event shall SHIRTS UP be liable or responsible for any damages or consequences arising from or related to your inappropriate or unauthorized use of the contracted services.

OFFICE HOURS: Our office hours are 10:00 AM – 6:00 PM Monday-Friday, Saturday & Sunday by Appointment Only.

TURNAROUNDS: Standard Turnaround Times: 3-4 Weeks. In house/stocked items or services 2-3 Weeks. Faster service requires a Rush Order fee.

Rush Orders (Shipping cost and time not included): Next Day - add 75% of your total.
2 Day* - add 50% of your total. 3 Day* - add 35% of your total. 4 Day* - add 25% of your total. 5 Day* - add 15% of your total. 6-10 Days* - add 10% of your total. *includes business days only - Anything over 10 business days does not require a rush order charge. - To have an order shipped out on a Saturday, add a $20.00 service fee. - The above pricing does not include rush shipping which is additional and varies. - NO REFUNDS ON RUSHED OR EXPEDITED ORDERS AND PROJECTS.

RETURNS / REFUNDS: Any artwork fees or Graphics services are non-refundable. If artwork is not approved or accepted, 50% of artwork fee may be refunded.
Any cancellation or compensation given to the customer will be refunded in a timely manner. Please allow up to 15 business days for the monies to be credited to your account. Customer must notify SHIRTS UP within 48 Hours of order to notify any defects discovered in the ordered product or the claim will be denied. In order to receive replacement, Customer must return 100% of the received product within 7 business days (at their own expense) for review. All charges related to expedited services (Rush Orders or Shipping) are non refundable.

CUSTOMER CONTENT: You understand that all information, data, text, photographs, graphics, messages or other materials ("Content") are the sole responsibility of the person from which such Content originated. This means that you, and not SHIRTS UP, are entirely responsible for all Content that you use form SHIRTS UP gallery or send, upload, post or transmit via the Service. Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content.

CREATED CONTENT: SHIRTS UP retains all printing and duplication rights to any artwork, logos, graphics, or designs created by SHIRTS UP, and affiliates. Any and all purchased artwork includes usage rights for up to but not to exceed 24 months. Additional usage rights may be purchased for 12-month increments at 10% original purchased rate unless otherwise agreed upon. All copyrights of created content are immediately transferred to the client for 24 months upon full purchase of created content, excluding hard goods and or any printed material unless otherwise agreed upon. SHIRTS UP will NOT refund any created artwork after the project has started and been agreed upon. Created Content includes any artwork, logos, graphics, layouts, or designs. One draft is provided with each form of created content, and any additional drafts will incur fees of up to 50% of total project cost. Revisions start at $35.00 each, not to exceed 50% of full project price. . Purchased designs receive 1 free draft changes, and 2 revisions or modifications. Drafts are described as a new or reworked design, revisions are small adjustments to text, placements, colors, or any other minor changes to the first submitted draft. Shirts Up requires a minimum 50% deposit on all artwork estimates, which is NONREFUNDABLE.

INDEMNITY: You agree that you shall indemnify and defend SHIRTS UP and all parties from whom SHIRTS UP has licensed portions of Content, and their directors, officers, and employees, against all claims, liability, damages, costs, and expenses, including reasonable legal fees and expenses arising out of or related to (i) your breach of these Terms of Use or (ii) any suit, claim, or demand arising from or relating to any text, photograph, image, graphic or other material you incorporated into Products.

ORDER APPROVAL: Please review your order prior to submitting. Effective 48 HOURS after an order has been received, SHIRTS UP will no longer accept changes or cancelations to orders that have been placed. We apologize for any inconvenience this may cause. The customer is fully responsible for final proof and layout approval prior to the printing process. SHIRTS UP is NOT LIABLE for errors in a final product caused by any of the following reasons: Color Matching, Faulty Apparel Manufacturing, Misspelling, Graphics, Bleeds, Grammar, Damage Fonts, Punctuation, Wrong cuts, Incorrect or Missing Folds, Die Lines, Crop Marks, Transparency, Overprint, Finished Product Size. We DO NOT make any changes to customer files, without charging a design fee. THE IN-HOUSE HOURLY RATE FOR ANY ADDITIONAL OR PROVIDED SERVICES IS 150.00 PER HOUR. OUR STANDARD DESIGN RATE IS 200.00 PER HOUR UNLESS OTHERWISE QUOTED. By submitting the above document to SHIRTS UP "I agree to the following terms". I have verified that spelling and content are correct. I am satisfied with the document layout. I understand that my document will print as it appears here, that I cannot make any changes once my order is placed and that I assume all responsibility for typographical errors.

CUSTOMER SUBMITTED ARTWORK OR GRAPHICS: All artwork or designs and images must be provided in CMYK format. Acceptable artwork software formats include AI, PS, EPS, PDF, JPEG, and for text or single color images, GIF or TIF. SHIRTS UP is not responsible for any color shift that occurs in conversions from RGB to CMYK or PMS Pantone colors to CMYK color modes. All artwork, designs, and images must be provided in minimum of 300 DPI and CMYK color mode. SHIRTS UP is not responsible for images printed as fuzzy, distorted or pixilated due to customer provided artwork. SHIRTS UP is not responsible for any color shift in converted photographs (RGB images) with black, near black, or gray tones. Color shifts from a perceived black or gray must be addressed prior to file submission. Proofs do not guarantee black, near black or gray final output. If any revisions or modifications must be made to supplied artwork for artwork to become print ready, SHIRTS UP will charge the hourly rate of up to $150.00, unless otherwise specified or agreed upon invoice.

COLOR PROOFING & MATCHING: SHIRTS UP is not liable for color matching or ink density on screen proofs approved by the customers. Screen proofs will predict design layout, text accuracy, image proportion, and placement, but not color or density. If you wish to have your inks Pantone matched, you are required to purchase 1 gallon of custom Pantone mixed ink at $150.00 per gallon.

ORDER CANCELLATION: SHIRTS UP will be happy to help you cancel your order prior to Processing(within 24 hours). However, orders may not be eligible for cancellation upon request via email. Our Customer Service Team will inform you of any cancellation charges depending on the stage of the order. Please allow up to 15 business days for the monies to be credited to your account. Orders may not be canceled or refunded once they have been Screened, Plated or any process thereafter. Absolutely no refunds will be issued once an order has been Screened, Plated or any process thereafter, including but not limited to Printing, Coating, and/or Finishing. Once the order has been placed successfully, No Refunds are issued for Logo and Graphic design services, including any drafts or revisions. SHIRTS UP is not responsible for any duplicated orders that are placed on our website due to the customer mistake. We reserve the right to charge up to a 30% restocking fee on items, as well as shipping and handling fees.

RE-ORDERS: Effective 08.01.08 SHIRTS UP. is hereby notifying customers that due to system requirements all electronic files for job orders will not be kept in our system for more than 120 days after the order date unless otherwise specified. Due to this limitation, we no longer accept reorders of previously printed jobs after 6 months without incurring new setup fees. All files need to be re-submitted every time an order is placed. We apologize for any inconvenience this may cause. If you have any questions please contact our customer service department.

ORDER SHIPPING AND DELIVERY: SHIRTS UP: will always act to make sure that any production difficulties do not delay delivery schedules. In no case shall SHIRTS UP be liable for any consequential or damages resulting from any delay in shipment or delivery. All SHIRTS UP customers agree not to hold SHIRTS UP liable for delays in shipments caused by weather conditions, shipping company delays, international customs issues or any other circumstances beyond SHIRTS UP direct control. SHIRTS UP shipment and delivery dates are calculated based upon estimates provided by our suppliers. SHIRTS UP will always act to make sure that delivery schedules are met. However, unexpected equipment failure, malfunction and or technical problems may delay the printing process. In case of delay caused by technical difficulty, rush charges/fees will be refunded or waived where applicable. However, technical difficulty will not be the grounds for order cancellation. SHIRTS UP can only use its own shipping account and will not use customer provided account numbers for any couriers. Orders must be shipped at whole quantities and may not be split up. Please note that we don't ship to P.O. Boxes.

SHIPPING ERRORS & LOST PACKAGES: Lost or damaged claims can only be filed for shipments over $50.00 in value and can only be done after 30 days from package shipment. SHIRTS UP is not responsible for 3rd party shipping errors, omissions or damaged shipments.

RMA POLICY (Return Merchandise Authorization): SHIRTS UP. guarantees prints will not be defective in accordance with industry standards. If a print is found to be defective, then you may contact SHIRTS UP for a reprint or other compensation. SHIRTS UP. must be contacted in writing via email within 48 hours. If product is deemed defective, one of the following resolutions will be offered: 1. SHIRTS UP will reprint. 2. SHIRTS UP will authorize a Return Merchandise Authorization (RMA) for you. A Quality Assurance representative will contact you within 24-48 hours of your initial query to help issue your RMA. Contact with the representative must be established within 5 business days to verify the request. SHIRTS UP. must receive the package within 15 calendar days after RMA is issued. Compensation will be processed only after a RMA has been issued and the entire product has been returned to SHIRTS UP. then the refund transaction will take place within 10 business days. Samples of the defective merchandise must be acquired prior to any resolution. All Artwork, Plating, Proofing, Digitizing, and Setup Fees are Non Refundable. Printed Apparel may appear different than appears on a/your computer screen. Colors, shape, and overall look might slightly differ than what appears on a digital level.

CUSTOMER SUPPLIED INCORRECT ADDRESS: When a package is not delivered due to an error made by the customer in submitting the proper shipping address, SHIRTS UP will reship the package with corrected address and charge an additional shipping fee for the shipment.
